Terms of Service

1. About us
drinkmonty.com is operated by Polka Drops Pty Ltd (ABN [41 665 912 765]), trading as Monty ("Monty", "we", "us", "our"), of [65 King William St, Kent Town], South Australia. We hold Liquor Licence No. [57625225], issued under the Liquor Licensing Act 1997 (SA).

By using this website or placing an order, you agree to these Terms. Please read them carefully. If you don't agree, please don't use the site.

2. You must be 18 or over
Monty products contain alcohol. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. By entering this website and placing an order, you confirm that:

  • you are 18 years of age or older
  • you are purchasing for yourself or another adult, and not on behalf of anyone under 18
  • the person receiving the delivery will be 18 or older.

We may ask for proof of age at any stage, and we may cancel any order where we reasonably believe it breaches these conditions.

3. Responsible service of alcohol
We are committed to the responsible sale and supply of alcohol. We reserve the right to refuse or cancel any order, and our delivery partners may refuse to hand over an order, where:

  • the recipient cannot provide valid photo ID showing they are 18 or over
  • the recipient appears to be intoxicated
  • the delivery would breach any liquor law in the place of delivery.

Refused deliveries are returned to us. A redelivery or restocking fee may apply.

4. Orders
Placing an order is an offer to buy. We accept it when we dispatch your order, not when you receive an order confirmation email. We may decline or cancel an order (with a full refund) if:

  • a product is out of stock
  • there is an obvious pricing or product error
  • we suspect fraud or unauthorised use of a payment method
  • the order breaches Section 2 or 3.

We may limit the quantity of any product sold per order or per customer.

5. Pricing and payment
All prices are in Australian dollars and include GST. Shipping costs are shown at checkout. We may change prices at any time, but changes won't affect orders we have already accepted. Payment is taken in full at checkout through our secure payment providers. We do not store your full card details.

6. Delivery
We currently deliver Australia-wide, excluding PO Boxes, parcel lockers and areas where the sale or supply of alcohol is restricted by law (including some regional and remote communities in the Northern Territory, Western Australia and Queensland). Delivery timeframes are estimates only and may be affected by things outside our control. Risk in the products passes to you on delivery. For full details, see our Shipping Policy.

Because our products contain alcohol, orders may require an adult (18+) to receive them, and may not be left unattended where liquor laws in your state require this.

7. Returns and refunds
Returns and refunds are handled under our Returns & Refunds Policy, which forms part of these Terms.

8. Product information
We do our best to describe and show our products accurately. Colours, packaging and labels may vary slightly from the images shown, and we may update recipes or packaging from time to time. Always check the product label for ingredients, allergen information, alcohol content and standard drinks before drinking.

9. Promotions and discount codes
Discount codes and promotions are subject to their stated conditions, can't be exchanged for cash, and generally can't be combined unless stated. We may withdraw or change a promotion at any time, and may cancel orders that misuse a code.

10. Using our website
You agree not to use this website for any unlawful purpose, to interfere with its operation, or to copy, scrape or reproduce its content without our written permission. We don't guarantee the website will always be available or error-free.

11. Intellectual property
All content on this website, including the Monty name, logos, designs, images, text and graphics, is owned by or licensed to us. You may not use it without our prior written consent.

12. Your content
If you send us content, such as reviews, photos or social posts tagging @drinkmonty, you give us a non-exclusive, royalty-free licence to use, reproduce and share it for marketing purposes, with credit where practical. You confirm the content is yours to share, that it doesn't feature anyone under 18, and that it doesn't show irresponsible drinking.

13. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

14. Limitation of liability
To the extent permitted by law, and subject to Section 13, we are not liable for any indirect or consequential loss arising from your use of this website or our products. Where our liability can be limited, it is limited to resupplying the goods or paying the cost of resupplying them.

15. Privacy
We collect and handle your personal information in line with our Privacy Policy.

16. Changes to these Terms
We may update these Terms from time to time. The version on this page at the time you place your order applies to that order.

17. Governing law
These Terms are governed by the laws of South Australia, and you submit to the non-exclusive jurisdiction of the courts of South Australia.
